Warners Solicitors provides a wide range of legal services for elderly clients and their carers. We are committed to providing expert advice that is client-focused as well as practical and sympathetic.

Issues affecting older clients, in particular, can be complex and varied, covering wills, lasting powers of attorney, Court of Protection issues, tax planning, property matters, care home fees and financial planning. We help clients to plan ahead, to place their affairs in order; we also help clients navigate the Court of Protection jurisdiction.

We have legal experts who are ‘Dementia Friends’ and two of our team who are ‘Dementia Friends Champions’ and able to deliver Dementia Friends Awareness Sessions. Many of our solicitors are members of Solicitors for the Elderly as well as the Society of Trust and Estate Practitioners (STEP). With us, you can be assured that the advice you receive from us is the best advice available.

Our office in Tonbridge is wheelchair accessible and has a client car park. Where appropriate, we will visit our elderly and vulnerable clients in their homes.

Gail Hall

Gail offers practical experience and advice to clients who need help arranging their inheritance and estate planning affairs. She advises on Wills, probate, inheritance tax, Lasting Powers of Attorney and Court of Protection issues, acting as an attorney and deputy for clients when needed. She has particular experience in advising farming clients on succession planning and is also a member of the team advising elderly and vulnerable clients. Before qualifying as a solicitor Gail spent 20 years working for fine art valuers and auctioneer, having graduated from the Courtauld Institute London University in History of Art and Architecture.

Martin Terrell

Martin is a partner in the Private Client Department and heads the Court of Protection team. Martin read law at Durham University and qualified in 1991. After working for a specialist personal injury firm in London and firms in East Sussex and Tunbridge Wells, he joined Warners as a partner in 2018. Martin is a well-known and acknowledged expert in Court of Protection matters. He is recognised as a leading individual by both legal directories, The Legal 500 and Chambers and Partners. Martin has lectured and written extensively on Court of Protection and elderly client matters. His books include A Practitioner’s Guide to the Court of Protection (Bloomsbury) (author of first three editions and contributor to new 4th edition, 2018); contributor to the Law Society’s Elderly Client Handbook (joint editor of 3rd edition and contributor to 4th and 5th editions); contributor to Finance & Law for the Older Client (LexisNexis), and Elderly Clients: A Precedent Manual (Jordans, 2016); annual contributor since 2008 to Court of Protection Practice (LexisNexis, 2020). He has lectured extensively on the Mental Capacity Act and Court of Protection practice procedure for Central Law Training, Jordans, LexisNexis, the Society of Trust & Estate Practitioners (STEP) and Solicitors for the Elderly (SFE).

Mary Shaw

Mary acts as a professional trustee for numerous trusts and is also a court-appointed administrator in a number of contentious estates and trusts. Mary prepares Wills and powers of attorney and advises on the administration of estates, powers of attorney and deputyship orders. She specialises in working with families, in particular helping them manage their assets held in trust. She has kept up her knowledge of family law in order to assist clients in managing trusts resulting from divorce or Children Act proceedings. Mary has been a partner at Warners since 2013 and before that was a partner/director in solicitors’ firms in London and Kent since the 1980s. Mary is Team Leader of the Private Client Team she supervises the lawyers within that team. She lives with her husband Rory Silkin in Staplehurst and is clerk to the JS Newlyn Charitable Trust and treasurer of the Friends of All Saints Church which are both Staplehurst charities. Mary is happy to meet with clients living in Staplehurst in their homes outside normal office hours. Mary is a member of the committee of management of Vincent Housing Association in Notting Hill and a member of the Reform Club. Mary read Philosophy and Law at New Hall (Murray Edwards) Cambridge in the late 1970s and in 2011 completed a Masters degree at Heythrop College London University in Ethics. She is interested in social justice and political ethics.
